1. Overview
Dear Health is a personal health management application that allows individuals to view, organize, and better understand their health information in one secure place.

Aggregate health data from connected devices and apps (such as Apple Health and wearables)
Provide an AI assistant that helps users interpret and interact with their health information in a conversational, educational way
Dear Health is currently in the development phase and may offer limited functionality until public release.
2. No Medical Advice
Dear Health does not provide medical advice, diagnosis, or treatment. All content and insights provided through the app, including AI-generated messages, are for informational and educational purposes only.
Always seek the advice of a qualified healthcare provider regarding any medical condition or treatment. Never disregard or delay professional medical advice because of something you read or see in Dear.
3. Eligibility and Accounts
You must be at least 18 years old to use Dear. By creating an account, you represent that you are legally able to enter into these Terms.
You are responsible for safeguarding your login credentials and for all activities that occur under your account. Notify us immediately at kris@mydearhealth.com if you believe your account has been accessed without authorization.
4. User Data and Privacy
When you use Dear, you may choose to connect or import personal health data. This may include medical records, lab results, medications, vital signs, and wearable-derived data.
We store and process this data on your behalf to provide the Service. We apply industry-standard security practices, including encryption in transit and at rest, secure authentication, and restricted internal access.
Dear Health is designed following HIPAA principles and privacy-by-design standards, although Dear Health Inc. is not yet a HIPAA-covered entity or business associate.

5. Planned Integrations and Data Sources
Dear may allow you to connect to healthcare providers or systems, such as Epic MyChart, to import health information through authorized APIs or patient portals.
Until such integrations are fully operational, you acknowledge that data availability may be limited, incomplete, or provided solely for demonstration and testing purposes.
Dear Health does not guarantee the accuracy, completeness, or timeliness of information received from external systems.
6. Acceptable Use
You agree to use the Service responsibly and only for lawful purposes. You must not:
Use Dear to collect or transmit any unlawful, harmful, or offensive material
Attempt to gain unauthorized access to data or systems
Reverse engineer, copy, or resell any part of the Service
Misuse Dear in ways that interfere with its operation or security
7. Intellectual Property
All intellectual property rights in the Service, including the software, design, branding, and content, belong to Dear Health Inc. or its licensors. You may not copy, distribute, modify, or create derivative works without prior written consent.
8. Beta or Pre-Release Features
Dear Health may offer beta or experimental features as part of product development. These features are provided “as is,” may change without notice, and may not be reliable or available at all times.
Your feedback and usage data may be used to improve the Service.

The Service is provided “as is” and “as available.”
Dear Health Inc. makes no warranties, express or implied, including any warranties of accuracy, reliability, merchantability, or fitness for a particular purpose.
We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that all data retrieved will be accurate or complete.
10. Limitation of Liability
To the fullest extent permitted by law, Dear Health Inc. and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Service.
In no event will our total liability exceed the amount you paid (if any) for the Service during the twelve (12) months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Dear Health Inc. and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your misuse of the Service or violation of these Terms.
12. Termination
We reserve the right to suspend or terminate your access to Dear at any time, with or without cause, including if you violate these Terms or engage in activity that may harm Dear or its users.
Upon termination, your right to use the Service ends immediately. We may retain limited data as required by law or for legitimate business purposes.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Contra Costa County, California.
14. Changes to These Terms
We may revise these Terms periodically to reflect product updates, legal changes, or new integrations. When changes are made, we will update the “Effective Date.” Continued use after such updates constitutes acceptance of the revised Terms.
